About these terms
These terms of use (Terms) explain how you may use this website and any of its content (Site). These Terms apply between The PA Way (we, us or our) and you, the person accessing or using the Site (you or your). Please read these Terms carefully before using the Site. By using the Site or otherwise indicating your consent, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should stop using the Site immediately.
These Terms apply to any parts of the Site, its functionality and content provided to you free of charge for information purposes only. If you purchase a membership or other paid product from The PA Way and access restricted parts of the Site, separate terms and conditions will apply as set out in Part B below in addition to these Terms.

Using the Site
The Site is for your personal and non-commercial use only. You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Site.
We make no promise that the Site is appropriate or available for use in locations outside of the UK. If you choose to access the Site from locations outside the UK, you acknowledge you do so at your own initiative and are responsible for compliance with any applicable local laws.
We try to make the Site as accessible as possible. If you have any difficulties using the Site, please contact us using the contact details in Section 2 above.
As a condition of using the Site, you agree not to misuse or attack the Site by knowingly introducing viruses, trojans, worms, logic bombs or any other material which is malicious or technologically harmful (such as by way of a denial-of-service attack), or attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.
We may prevent or suspend your access to the Site if you do not comply with these Terms or any applicable law.
Registration and password security
Use of the Site may require registration, particularly in order to access restricted areas of the Site. We are not obliged to permit anyone to register with the Site and we may refuse, terminate or suspend registration to anyone at any time.
You are responsible for making sure that your password and any other account details are kept secure and confidential. If we have reason to believe there is likely to be a breach of security or misuse of the Site through your account or the use of your password, we may notify you and require you to change your password, or we may suspend or terminate your account.
Any personal information you provide to us as part of the registration process will be processed in accordance with our Privacy Policy.
Infringing content
We will use reasonable efforts to: (a) delete accounts which are being used in an inappropriate manner or in breach of these Terms; and (b) identify and remove any content that is inappropriate, defamatory or infringes intellectual property rights, when we are notified of such behaviour, but we are not responsible if you have failed to provide us with the relevant information.
If you believe that any content which is distributed or published by the Site is inappropriate, defamatory or infringing intellectual property rights, you should contact us immediately using the contact details in Section 2 above.
Your privacy and personal information
Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and the supervisory authorities in the event you have a query or complaint about the use of your personal information.
Ownership, use and intellectual property rights
The intellectual property rights in the Site and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the Site (Content) are owned by us and our licensors.
We and our licensors reserve all our intellectual property rights (including, but not limited to, all copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means that we remain owners of them and are free to use them as we see fit.
Nothing in these Terms grants you any legal rights in the Site or the Content other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Site or the Content (including any intellectual property notices) and in particular, in any digital rights or other security technology embedded or contained within the Site or the Content.
Trade marks: “Loyal Royal”, “The PA Way”, The PA Way logo, “The CEO to your Glow”, “The Consistent Assistant”, “All-star Assistant”, “AssistantHood”, “The VA Vox” and “Rock and Glow” are all trade marked names under The PA Way brand and cannot be used without written consent.
Submitting information to the site
While we try to make sure the Site is secure, we do not actively monitor or check whether information supplied to us through the Site is confidential, commercially sensitive or valuable. Other than any personal information – which will be dealt with in accordance with our Privacy Policy – we do not guarantee that information supplied to us through the Site will be kept confidential and we may use it on an unrestricted and free-of-charge basis as we reasonably see fit.
Accuracy of information and availability of the Site
We try to make sure that the Site is accurate, up-to-date and free from bugs, but we cannot promise that it will be. We also cannot promise that the Site will be fit or suitable for any purpose. Any reliance that you may place on the information on the Site is at your own risk.
We may suspend or terminate access or operation of the Site at any time as we see fit.
Any Content is provided for your general information purposes only and to inform you about us and our products and news, features, services and other websites that may be of interest, but has not been tailored to your specific requirements or circumstances. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. You should always use your own independent judgment when using the Site and its Content.
While we try to make sure that the Site is available for your use, we do not promise that the Site will be available at all times or that your use of the Site will be uninterrupted.
Hyperlinks and third party sites
The Site may contain hyperlinks or references to third party advertising and websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party advertising or websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party advertising or website does not mean that we endorse that third party's website, products or services. Your use of a third party site may be governed by the terms and conditions of that third-party site and is at your own risk.
Our responsibility to you
If we breach these Terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By 'foreseeable' we mean that, at the time these Terms were formed, it was either clear that such loss or damage would occur, or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).
We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.
General
We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control.
If any provision of these Terms is or becomes unenforceable, the rest of the Terms will not be affected.
No delay or failure by us to exercise any right or remedy under these Terms or by law will operate as a waiver of that right or remedy, nor will we be prevented or restricted from exercising that right or remedy in future.
No one other than us or you has any right to enforce any of these Terms.
No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our updated Terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.
We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with us, please contact us as soon as possible using the contact details in Section 2 above.
The laws of England and Wales apply to these Terms, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country. Any disputes will be subject to the jurisdiction of the courts of England and Wales, although you can choose whether to bring a claim in the courts of another part of the UK in which you live.
Part B – Membership Terms
Registration
If you are a member of The PA Way, the Terms of this Part B apply to your use of the Site in addition to the Terms set out in Part A. You will need to register as a member in order to access certain features of the Site, including the forums.
When you register with us you are stating that you are over 18 years of age.
You agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete and that you will ensure that this information is kept accurate and up to date at all times. We reserve the right to terminate your membership and/or access to any specific content if we believe that you have provided us with false or misleading information.
Applications for membership
Applications for membership are subject to acceptance by us. We may, acting reasonably, accept or decline any application in our discretion and are not obliged to give reasons for our decision.
We may limit the number of memberships made available during any period, including limiting the number of memberships available for any particular membership product or during any calendar month.
Where all available memberships for a particular membership product have been allocated, we may operate a waiting list. Joining a waiting list does not guarantee that you will be offered a membership or that one will become available within any particular timeframe.
If we invite you to purchase a membership from a waiting list or otherwise, we may specify a period within which the membership must be purchased. If you do not complete your purchase within that period, we may withdraw the invitation and offer the membership to another applicant.
We may suspend, reopen or otherwise change the availability of memberships or any waiting list at any time.
Gold Pass membership period
Your Gold Pass membership starts on the date your application is accepted by us and we have received payment of the applicable Gold Pass membership fee.
Unless cancelled earlier in accordance with these Terms, your Gold Pass membership will continue for a period of 12 months from its start date. Shortly before the end of your Gold Pass membership period, we may invite you to renew your Gold Pass membership for a further 12-month period or for any other period we offer at that time.
Renewal of your Gold Pass membership is subject to: (a) payment of the applicable renewal fee, (b) your continued compliance with these Terms, and (c) availability of Gold Pass memberships at the time of renewal.
A Gold Pass membership does not automatically renew and you are not guaranteed the right to renew or purchase a further Gold Pass membership.
We may determine the number of Gold Pass memberships made available during any period and reserve the right to suspend, withdraw or amend the availability of Gold Pass memberships at any time.
If your Gold Pass membership expires or is terminated, your right to access and receive the benefits made available under your Gold Pass membership will immediately end, unless otherwise agreed by us in writing.
Other membership periods
We may introduce, amend or withdraw other membership products from time to time. The duration, renewal, expiry and other terms applicable to any such membership product may differ from those that apply to a Gold Pass membership and will be communicated to you at the time you purchase or renew the relevant membership.
Membership fees
The fee payable for each membership will be the fee displayed on our Site or otherwise communicated to you at the time you purchase or renew the relevant membership.
Unless we agree otherwise in writing, all membership fees must be paid in full before your membership starts or is renewed.
We may change membership fees from time to time. Any change will not affect your current membership but will apply to any future purchase or renewal of the relevant membership.
Different membership products may have different fees, payment structures, billing frequencies and renewal arrangements, which will be displayed on our Site or otherwise communicated to you at the time you purchase or renew the relevant membership.
We may offer promotional pricing, discounts or special offers from time to time. Unless expressly stated otherwise, any such promotional pricing, discount or special offer applies only to the relevant promotion, is subject to any additional terms we specify, and does not entitle you to the same pricing on any future purchase or renewal of the relevant membership.
We may accept payment using such payment methods as we make available from time to time.
If any payment due to us is declined, reversed, recalled or otherwise not successfully received, we may suspend or terminate your membership in accordance with these Terms until all outstanding amounts have been paid.
If any amount remains unpaid after we have requested payment, we reserve the right to recover all outstanding sums due to us together with any reasonable costs incurred in doing so, to the extent permitted by law.
If your membership ends for any reason, any refund will be dealt with in accordance with these Terms.
Gold Pass benefits
Your Gold Pass membership entitles you to receive the benefits, features, content, discounts, offers, events, resources and other services that we make available from time to time as part of your Gold Pass membership.
We will use reasonable endeavours to provide the benefits of your Gold Pass membership throughout your membership. However, we do not guarantee that any particular benefit, feature, event, resource, discount, supplier or service will remain available throughout your Gold Pass membership.
We may add, remove, replace or amend any aspect of your Gold Pass membership at any time, provided that doing so does not materially diminish the overall value of your Gold Pass membership.
Some aspects of your Gold Pass membership may be provided by third parties. Whilst we will use reasonable care in selecting those third parties, we are not responsible for any act or omission of those third parties or for any third-party benefit that is amended, withdrawn or becomes unavailable for reasons outside of our reasonable control.
We may change the Site, platform, application or other technology through which your Gold Pass membership is provided at any time. Where reasonably practicable, we will give you advance notice of any material change.
Other membership products may include different benefits, features, content, discounts, offers, events, resources and services, which will be displayed on our Site or otherwise communicated to you at the time you purchase or renew the relevant membership.
Cancellation
You have a legal right to cancel your membership within 14 days of purchasing it (known as the "cooling-off period"). If you wish to exercise this right, you should notify us by emailing us at [email protected] before the end of the cooling-off period. Subject to the remainder of this clause, we will refund any membership fee you have paid.
If, during the cooling-off period, you request immediate access to your membership and we begin providing services under your membership before the end of that period, you acknowledge that you will be responsible for paying for the services you have received up to the date you notify us that you wish to cancel. Any refund will be reduced accordingly.
Following the expiry of the cooling-off period, you may cancel your membership at any time by giving us written notice. Unless these Terms or the terms applicable to your membership expressly provide otherwise, or unless we otherwise agree in writing, no refund will be payable where you choose to cancel your membership.
We may suspend or terminate your membership immediately by giving you written notice if: (a) you commit a material breach of these Terms, (b) you fail to pay any amount due to us, (c) we reasonably believe that your conduct is harmful to us, our community, our members or our reputation, or (d) we reasonably consider it necessary to protect the integrity, security or proper operation of The PA Way or our community.
We may also terminate your membership at any time without cause by giving you written notice. Where we do so, we will refund any membership fee you have paid in respect of any unused period of your membership, unless the terms applicable to your membership provide otherwise.
We may, from time to time, introduce, amend or withdraw membership products. Where you choose to change from one membership product to another, we may charge any additional fee payable, refund any difference in fees or apply a pro-rata adjustment, as appropriate.
Any refund under these Terms will be made using the original payment method unless we agree otherwise with you.
Where your membership ends for any reason, your right to access any membership-only content, resources, benefits and areas of the Site will end immediately unless we expressly agree otherwise.
Use of the Site
In addition to the provisions set out in Part A of these Terms, you agree to use the Site, your membership and The PA Way lawfully, responsibly and in a way that respects other members. You must not use the Site or your membership for any purpose that is unlawful, misleading or likely to damage, disrupt or adversely affect The PA Way, our members or our reputation.
Your membership is provided solely for your own personal use. You must not share your login details, permit any other person to access your account, or otherwise allow any third party to access or use your membership.
Unless we have given our prior written consent, you must not use the Site, your membership, our events or our community to advertise or promote any business, product, service, membership, community or event, or to recruit, solicit or encourage members to join any competing business, membership, community or service. You must not use any contact details or other information obtained through The PA Way to market or promote your own or another person's products or services.
You must not copy, reproduce, record, distribute, publish, sell, licence or otherwise make available any content, resources, materials or information made available through The PA Way, the Site, the AssistantHood app or any other platform we make available from time to time other than for your own personal use. You must not use any such content, resources, materials or information to create, develop or operate any competing business, membership, community, course or service.
You must not use any automated system, software or technology, including web scraping tools, bots or artificial intelligence tools, to extract, analyse, copy or reproduce any content or information made available through The PA Way, the Site, the AssistantHood app or any other platform we make available from time to time without our prior written consent.
You must not upload, publish, send or distribute any content or material that is unlawful, defamatory, abusive, threatening, discriminatory, harassing, misleading, obscene, infringes another person's rights or is otherwise objectionable. You must also not engage in any behaviour which, in our reasonable opinion, is likely to disrupt the enjoyment of The PA Way by other members or adversely affect the operation or reputation of The PA Way.
If we reasonably believe that you have breached this clause, we may remove any content you have posted, restrict your access to any part of The PA Way, suspend your membership or terminate your membership in accordance with these Terms.
Protecting our community
During your membership and for a period of 6 months after it ends, you must not directly or indirectly solicit, encourage or attempt to encourage any member of The PA Way whom you became aware of through your membership to leave The PA Way for the purpose of joining or using any competing business, membership, community, course or service.
During your membership and for a period of 6 months after it ends, you must not use any contact details, personal information or other information obtained through The PA Way to market, promote or provide any competing business, membership, community, course, programme or service to any member of The PA Way.
During your membership and for a period of 6 months after it ends, you must not use any confidential information, materials, resources or know-how obtained through The PA Way to establish, develop, operate, assist or otherwise support any business, membership, community, course or service that competes with The PA Way.
Nothing in this clause prevents you from carrying on your own business or profession generally, provided that you comply with these Terms and do not use The PA Way, its members, confidential information or resources in breach of this clause.
You acknowledge that the restrictions in this clause are reasonable and necessary to protect our legitimate business interests, including our confidential information, goodwill, community and relationships with our members.
Content
If you submit or upload any content to the Site or otherwise make it available through The PA Way, the Site, the AssistantHood app or any other platform we make available from time to time, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, adapt, publish, distribute and otherwise use that content for the purposes of operating, promoting and improving The PA Way.
You warrant that you own, or have obtained all necessary rights, permissions and consents to submit or upload any content you make available through The PA Way and that doing so does not infringe the rights of any third party. You remain responsible for all content that you submit or upload.
If you upload photographs, videos or other content featuring another person, you are responsible for ensuring that you have obtained any consent necessary to upload and share that content through The PA Way.
We may, at any time and without notice, edit, remove, refuse to publish or otherwise moderate any content that we reasonably believe breaches these Terms or is otherwise inappropriate, unlawful or detrimental to The PA Way or its members.
We do not necessarily endorse, support or agree with any comments, opinions, advice or other content shared by members through The PA Way. Any such content reflects the views of the member who posted it and not our own.
All content, resources, templates, guides, videos, recordings, presentations, materials and other information that we make available through The PA Way remain our intellectual property or that of our licensors. Your membership gives you a limited, non-exclusive, non-transferable right to access and use those materials for your own personal use during your membership only.
Except where we have given our prior written consent, you must not copy, reproduce, modify, distribute, publish, sell, license, commercially exploit or otherwise use any content or materials made available through The PA Way, the Site, the AssistantHood app or any other platform we make available from time to time, nor may you use them to create or support any competing business, membership, course, community or service.
Events
We may organise, host or facilitate in-person or online events from time to time. Unless expressly stated otherwise, attendance at any event is not included as part of your membership and separate fees may apply.
Some membership products may include access to particular events or discounted event fees. Any such entitlement will be displayed on our Site or otherwise communicated to you at the time you purchase or renew the relevant membership.
We reserve the right to determine the format, location, date, time, speakers and content of any event and may substitute speakers, change venues, move events online, reschedule or cancel events where reasonably necessary. Where we cancel an event and do not offer a suitable alternative, we will refund any event fee you have paid in respect of that event. We will not be responsible for any other costs or losses you incur as a result of the cancellation or rescheduling of an event.
You are responsible for all travel, accommodation and any other costs you incur in attending an event, unless we expressly agree otherwise. You are also responsible for any loss of, damage to or unauthorised removal of any property at the venue whilst attending an event. If we incur any cost, charge or other liability as a result of your actions, you agree to reimburse us for that amount on demand.
You must conduct yourself professionally and respectfully at all times when attending an event. If, in our reasonable opinion, your behaviour is disruptive, inappropriate, abusive, discriminatory, threatening or otherwise unacceptable, we may require you to leave the event immediately, refuse you entry to future events, suspend or terminate your membership and, where appropriate, remove you from The PA Way.
We may photograph, film or otherwise record our events for promotional, educational or other business purposes. By attending an event, you acknowledge that you may appear in such photographs or recordings. If you do not wish to be included, please let us know before the event and we will use reasonable endeavours to accommodate your request, although we cannot guarantee that this will always be possible.
Warranties and liability
We warrant that we will provide your membership using reasonable care and skill.
We may make available benefits, services, events, discounts or other features that are provided by third parties. We do not give any warranty or guarantee in respect of any third-party products, services or providers and are not responsible for any act or omission of any third party.
Whilst we will use reasonable endeavours to provide the benefits of your membership, we do not warrant that any particular feature, benefit, event, resource or item of content will always be available or uninterrupted.
Except in the case of death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited, we will not be liable for any loss arising out of or in connection with your membership that was not reasonably foreseeable at the time you purchased your membership. We will not be liable for any indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill or loss of anticipated savings.
Subject to the paragraph above, our total liability arising out of or in connection with your membership will not exceed the total membership fees paid by you in respect of the membership giving rise to the claim.
We will not be liable for any delay or failure to provide any aspect of your membership where this is caused by circumstances outside of our reasonable control. Where an event for which you have paid a separate fee is cancelled by us and we are unable to offer a suitable alternative, our liability will be limited to refunding the fee you paid for that event.
Confidentiality
During your membership, you may receive or have access to confidential information belonging to us, other members or third parties, including information shared through our events, community, resources, discussions and other aspects of The PA Way.
You agree to keep all such confidential information confidential and not to disclose it to any third party or use it for any purpose other than participating in your membership, unless the information is already publicly available (other than through a breach of this clause), you are required to disclose it by law, or you have obtained the prior written consent of the person to whom the information belongs.
You must not disclose, share or otherwise make available any confidential information, content, resources, materials or other information obtained through The PA Way with any other membership organisation, community, network, committee or similar organisation without our prior written consent.
Nothing in these Terms prevents you from using your own general knowledge, experience or skills acquired during your membership, provided that you do not disclose or misuse any confidential information belonging to us, our members or any third party.
Your obligations under this clause will continue after your membership ends.
Data protection
In order to provide your membership, we will need to collect, use and otherwise process certain personal data about you.
We will process your personal data in accordance with our Privacy Policy, which forms part of these Terms and is available on our Site.
You are responsible for ensuring that any personal data you provide to us is accurate and kept up to date.
General
You may not assign, transfer, sub-contract or otherwise deal with any of your rights or obligations under these Terms without our prior written consent.
We may transfer any of our rights or obligations under these Terms to another person or organisation, provided that doing so will not adversely affect your rights under these Terms.
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be deemed severed and the remaining provisions will continue in full force and effect.
No delay or failure by us to exercise any right or remedy under these Terms or by law will operate as a waiver of that right or remedy, nor will it prevent or restrict the further exercise of that or any other right or remedy.
We may amend these Terms from time to time. Where we make any material changes, we will make the updated Terms available on our Site and, where appropriate, notify you by email or by another appropriate method. By continuing your membership after the updated Terms take effect, you agree to be bound by the amended Terms.
These Terms, together with our Privacy Policy and any other documents expressly referred to within them, constitute the entire agreement between you and us in relation to your membership and supersede any previous discussions, correspondence or understandings relating to it.
These Terms and your membership are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction to determine any dispute arising out of or in connection with these Terms or your membership.
